In the past several months I have observed hundreds of unethical and illegal
foreclosures taking place in my home state of Arizona. Many Trustees and
attorneys are knowingly processing non-judicial foreclosures, lis pendens
and evictions of homeowners for mortgage lenders who have no viable legal
interest in properties.
What’s more disturbing is that many courts are accepting affidavits “in lieu
of” the original notes by mortgage lenders, which are needed to bring
legitimate legal action to regain title.
Many of the actual owners of the current mortgages on the market are
unknown to the Trustees that process non-judicial foreclosures. Nearly
100% of all loans “secured” by residential real property were securitized,
which means that these loans, false from in their inception, went on a
journey to “never never land” where securities, also false from inception,
were sold to investors to fund the transaction.

their property rights during this subprime crisis.
